The Texas Option. Four new states.

Did you know? The Treaty of Annexation that made Texas a state, also granted Texas the right to unilaterally carve new states out of itself. The treaty allows up to four new states.

Article 4, section 3 of the US constitution allows state legislatures to create new states out of their own territory. The Treaty of Annexation of 1845 specifically expands upon this right for Texas.

The Treaty contains the following language.

New States of convenient size not exceeding four in number, in addition to said State of Texas and having sufficient population, may, hereafter by the consent of said State, be formed out of the territory thereof, which shall be entitled to admission under the provisions of the Federal Constitution.
